Tavid AS is organising a commercial lottery (hereinafter the lottery) in accordance with these lottery instructions and rules. The winner will receive two VIP tickets to the 2025 Vienna Philharmonic Orchestra Summer Night Concert, including Tallinn-Vienna-Tallinn flight tickets and accommodation for two nights in a 4* hotel.

Lottery name: ‘Münze Österreich & Tavex Group – Summer Night Concert 2025!’

Lottery organiser: Tavid AS, registration number 10055700, Pärnu maantee 186, Harjumaa, 11314 Tallinn, Estonia

Lottery description: Participants in the lottery will have the chance to win two VIP tickets to the Vienna Philharmonic Orchestra Summer Night Concert on 13^th of June 2025 in Vienna, Austria (https://www.wienerphilharmoniker.at/en/summernightconcert). The prize includes two VIP tickets to the concert, two Tallinn-Vienna-Tallinn flight tickets, and accommodation for two nights (12–14 June) for two people in a 4-star hotel in Vienna. To participate in the lottery, the customer must, during the lottery period, make a personalised purchase or purchases at the online store or office of the lottery organiser, purchasing a total of at least one troy ounce (1 oz) of Münze Österreich (Austrian Mint) 2024 or 2025 Philharmonic or Austrian Franz Jospeh 1 ducat gold coins. Purchases of backdated gold coins (i.e. from earlier years) do not qualify for the lottery. Customers who have purchased one 1 oz Austrian Philharmonic coin during the lottery period, as well as those who purchase, for example, two 1/2 oz, four 1/4 oz, or ten 1/10 oz Austrian Philharmonic gold coins or at least nine Austrian Franz Joseph 1 ducat gold coins, will all take part in the lottery. All customers who have purchased at least 1 oz or more of coins during the lottery period are entered into the lottery automatically.

Lottery period: from 25 October 2024 at 12 a.m. until 31 December 2024 at 11:59 p.m.

1. 1. Qualification

Regardless of any other requirements set out in the terms and conditions of the lottery, only natural persons who are at least 18 years of age and permanently resident in Estonia at the time of purchase can participate in the lottery. Employees of Tavid AS and its group companies (Tavex Group), as well as spouses, registered partners or direct blood or collateral relatives of such persons, are not eligible to participate in the lottery.

2. 2. Participation in the lottery

To take part in the lottery, the customer must:

• *meet the residence and age requirements set out in clause 1 of these rules; and
• *purchase (during the lottery period) a total of at least 1 oz of Münze Österreich gold products:
  1. the Philharmonic 2024 gold coins; or
  2. the Philharmonic 2025 gold coins; or
  3. Austrian Franz Joseph 1 ducat gold coins; and
• *provide identification information when carrying out the transaction.

In the following, we will further explain the terms related to the above criteria.

The customer must buy a total of at least 1 oz of Münze Österreich gold coins. The following products are eligible for the lottery:

• 1 oz Austrian Philharmonic gold coins
• 1/2 oz Austrian Philharmonic gold coins
• 1/4 oz Austrian Philharmonic gold coins
• 1/10 oz Austrian Philharmonic gold coins
• Austrian Franz Joseph 1 ducat gold coin

Purchases can be made both at the online shop of the lottery organiser (www.tavid.ee) and at its offices in the Republic of Estonia. Coins can be purchased in one or several separate transactions, and 1 oz can be purchased as a single product or as a combination of several products. Therefore, customers who have purchased one 1 oz Austrian Philharmonic gold coin during the lottery period, as well as to those who purchase, for example, two 1/2 oz, four 1/4 oz, or ten 1/10 oz Austrian Philharmonic gold coins or at least nine Austrian Franz Joseph 1 ducat gold coins, will all take part in the lottery.

To participate in the lottery customer must provide identification information when carrying out the transaction. This means that the identity of the customer must be verified when carrying out the transaction. When making a purchase in the online shop, the customer must enter their name, personal identification number and/or date of birth, and contact details. When making a purchase at an office, the customer must present an identity document (ID-card, residence permit, passport, or Estonian driving licence) and contact details to the Tavid AS representative (cashier). Transactions carried out by the customer where their identity was not identified will not take part in the lottery.

The lottery is automatically open to all customers who meet the above conditions. All customers who meet the conditions to participate in the lottery will be entered into the lottery with a personalised ticket. All customers who meet the above eligibility criteria will participate in the lottery on equal basis. Purchasing more than 1 oz of products will not affect the chance of winning.

3. 3. Prize

One winner will be determined. The prize for the winner is:

• *two VIP tickets to the Vienna Philharmonic Orchestra “Summer Night Concert 2025” on 13^th of June 2025 in Vienna, Austria;
• *Tallinn-Vienna-Tallinn flight tickets for two;
• *hotel room for two for 2 nights (12–14 June) in a 4-star hotel

The ‘Münze Österreich & Tavex Group – Summer Night Concert 2025!’ lottery is organised by Tavid AS and Münze Österreich AG. In addition to Estonia, the lottery will be held in other countries where Tavex Group companies are represented. Participants in the lottery in Estonia cannot take part in lotteries in other countries.

4. 4. Drawing of winners and notification

The winner of the lottery will be drawn at random from all eligible participants. The draw will take place within five (5) working days after the end of the lottery period at the head office of Tavid AS at Pärnu maantee 186, 11314 Tallinn.

The winner will be notified no later than two (2) working days after the draw via the email address provided by the lottery participant at the time of purchase. The lottery organiser is not responsible for the participant not receiving the email in case the email ends up in their spam folder or the winner is unable to receive the email for other reasons beyond the control of the lottery organiser (e.g. due to mailbox security settings, incorrect or inaccurate contact details etc).

The lottery organiser has the right to disqualify the winner of the initial draw, refuse to issue the prize, and draw a new winner in accordance with the procedure set out in this section if:

• *the winner does not qualify under the conditions set out in these rules;
• *the winner refuses to sign and return the waybill for the prize;
• *the winner cannot be contacted within 14 (fourteen) days after the draw has taken place; or
• *the winner informs the lottery organiser that they cannot or do not wish to use the prize personally for any reason and/or wish to give the prize to a third person other than their first-degree descendant (child) or ascendant (parent).

5. 5. Privacy and data protection

By making a purchase, the lottery participant consents to the lottery organiser processing their personal data in accordance with the procedure set out in the data protection terms and conditions of Tavid AS. The participant can consult the data protection terms and conditions at https://tavid.ee/andmekaitse-tingimused/. With the consent of the participant, Tavid AS collects personal data, such as name, personal identification number (or date of birth), and e-mail address, only for the purpose of conducting the lottery.

The processing of personal data is carried out in accordance with the General Data Protection Regulation (GDPR) and other current and applicable legislations. Participants in the lottery have the right to withdraw their consent to the processing of their personal data, to access and rectify the data collected about them, to request the erasure of their data on the grounds set out in the GDPR, and to object to the processing of their data at any time. To exercise your rights, please contact tavid@tavid.ee. Personal data will not be kept for longer than necessary to achieve the purposes for which they were collected, after which the data will be erased.

6. 6. Rights of the organiser

The lottery organiser reserves the right to cancel the lottery as a whole or partially, to suspend it temporarily, or to unilaterally change the terms and conditions of the lottery. The right to do so will only be exercised if it is necessary to ensure the fairness or proper practice of the draw, including to avoid possible fraud.

The lottery organiser reserves the right, at its sole discretion, to disqualify any participant who violates these rules, attempts to manipulate the results of the draw, or seeks to gain an unfair advantage over other participants.

7. 7. Tax issues

When issuing prize, the lottery organiser pays taxes in accordance with the procedure laid down in the laws of the Republic of Estonia. Pursuant to clause 2 (5) 4) of the Gambling Act, the provisions of the Gambling Act do not apply to the conduct of this lottery. The lottery organiser is not liable for any tax liability that may arise, be declared, or paid by the prize winner. The winner is solely responsible for declaring and paying all applicable taxes in connection with the prize and for any expenses incurred in connection with the prize.
